    Money is not everything that counts. I would rather want to get less money and not be treatend like shit from the company/publisher instead.

    Hahahhahahahahahhahahahahaha...hmm. That's the difficult thing these days.

    I'm lucky. My company doesn't treat me like shit. Certain publishers though, offer no guarantees.

    That sounds more reasonable and what law in Germany and other European countries is. You just can't write some contract with ridiculous restrictions and as soon as the other person signs it it is legal.

    Whether the non competing clause could be considered excessive is debatable, I think for key positions it makes sense. If you are a top manager and have access to all the company's information and switch to the competition within one month this would be quite bad. However if mid profile employees who don't earn a whole lot are not allowed to work for 6 months or longer I think this clause is bs.

    The level at which you're employed is pretty much the yardstick for non-compete clauses. Some financial brokerage houses prevent their CEOs and CFOs from working for competitors for life, and the courts have backed them up. People in those positions know exactly what a company's investment strategies are, which basically is a formula to make billions. Of course, they also get ridiculous severance and retirement packages that are tipping near 100US million to make sure that they are set for life and don't need to go work. It's hard to argue to a judge that in addition to 60 million in severance plus hundreds of millions more made in salary, plus millions more in investments that you're at a financial disadvantage because of unemployment.

    ....good thing average game developers get 100Milllions in severance if they get fired....
